Patents are valuable assets and therefore should be protected. They comprise any inventions, in any area of technology, pertaining to products or processes which can be obtained.

File an Invention Patent / Utility Patent

The following information and documentation is required:

1 Applicant – name, nationality, address and commercial nature (commercial, industrial or other).

2 Inventor – name, nationality and address of the inventor.

3 An Abstract of the invention with a summary description (not more than 150 words or 400 characters).

4 A description of the invention patent.

5 Details of what are considered to be the key characteristics of the invention and those elements which are deemed to be novel.

6 Descriptive drawings (if applicable).

7 Notarised Power of Attorney – a blank sample should be completed, to give us permission to represent you before the Macau Economy Services (it is required to submit one Power of Attorney per application, original or certified true copy).

8 Priority (if claimed) – priority filing date, number and country, along with a certified copy of the priority application (within the first three months following the application).

Invention Patent

Timeline: Eighteen months after application, a notice will be published in the Official Gazette. Within the seven years that follow the initial filing, the applicant must request or submit the examination report. If all is filed and requested without delays, the Macau Economic Services will take three years from the receipt of application to registration, provided that there are no deficiencies in the application and no objections are raised by the Macau Economic Services or by a third party.

Protection: If protection is granted the registration will be effective for twenty years from the day of application.

Utility Patent

Timeline: Eighteen months after the application, a notice will be published in the Official Gazette. Within the four years that follow the initial filing, the applicant must request or submit the examination report. If all is filed and requested without delay, the Macau Economic Services will take two years from receipt of application to registration, provided that there are no deficiencies in the application and no objections are raised by the Macau Economic Services or by a third party.

Protection: If protection is granted, the registration will be effective for ten years from the day of application.
